Kenya Kenyan Constitution Recognition Of Earth Law Principles
Kenyan partners of the African Biodiversity Network played an important role in the drafting of the Kenyan Constitution, advocating for recognition of community rights to govern their land and territory according to Earth Jurisprudence principles.
Those involved included Professor Wangari Maathai (Greenbelt Movement), Ng'ang'a Thiong'o, Kariuki Thuku and Tetu Maingi (Porini Association), Institute for Culture and Ecology, with legal advice and support from Cormac Cullinan (EnAct International, South Africa) and Gaia Foundation.
While many progressive provisions embedding Earth Law principles were removed, strong provisions on culture and community land remained. Work lies ahead to ensure the Kenyan Constitution is interpreted in a manner which upholds Earth law principles.
